Terms of Use — My Photo Copy

The short version. You may use My Photo Copy on the Apple devices you own. It copies your photos onto storage you choose and checks each copy. It is not a substitute for keeping more than one copy of anything you care about, it has no restore feature, and it cannot run while it is in the background. Pro is either a one-time purchase or a yearly auto-renewing subscription; Apple takes the payment and Apple handles refunds.

1. Who these terms are with

My Photo Copy is published by Technabit e.U., Riedelstrasse 1, 6330 Kufstein, Austria ("we", "us"). By downloading or using the app you accept these terms. If you do not accept them, do not use the app.

2. Licence

The app is licensed, not sold. You get a personal, non-exclusive, non-transferable licence to use My Photo Copy on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service.

Apple's Licensed Application End User Licence Agreement applies to this app in addition to these terms. Where the two conflict, Apple's EULA governs the licence itself and these terms govern everything else. Apple is not a party to these terms, has no obligation to provide support for the app, and its only responsibility for the app is the refund of the purchase price, as its EULA sets out.

You may not reverse-engineer, decompile, redistribute, rent or resell the app, except to the extent that Austrian or EU law expressly permits it despite this restriction.

3. What the app does

My Photo Copy reads the original file behind each photo and video you select and writes it to a destination folder you choose with Apple's Files picker — a USB stick, an external SSD, an SD card reader, iCloud Drive, or a folder in "On My iPhone". It then reads each written file back off that destination and compares its SHA-256 hash with the data your iPhone streamed out, and its size with the size your photo library reports for the original. A file is reported as verified only when both match.

The files land as ordinary photos and videos in dated folders. Nothing is compressed, converted, renamed against your settings, packed into an archive, or encrypted. Any computer can read the result without this app.

4. What the app does not do — please read this part

It is not a restore tool. There is no way to put photos back onto an iPhone from within the app. Getting them back means plugging the drive into a computer and copying the folders, which works precisely because the files were never packed into a proprietary format.
One drive is one copy. A single copy on a single drive is not a backup strategy. Drives fail, are lost, and are stolen. Keep another copy somewhere else, ideally in another building.
It cannot run in the background. iOS suspends apps shortly after they leave the screen. A large backup pauses when you switch away and continues when you come back, so a first full run should be done with the phone on a charger and the app in front of you.
It needs Full Access to your photo library. iOS Limited Access hands apps a preview rather than the original file, and a preview cannot be backed up or verified.
Hardware is your side of the bargain. iPhone 15 and later have USB-C; earlier iPhones need a Lightning-to-USB adapter. Some SSDs and hard drives need their own power or a powered hub. We cannot guarantee that any particular drive, adapter, hub or file system will work with your device.
Verification proves the copy, not the original. The check confirms that what landed on the drive matches what your iPhone sent and the size your library reports. It cannot repair a photo that was already damaged in your library.
It does not delete anything. My Photo Copy never removes photos from your iPhone and never removes files from your drive.

Do not delete an original from your iPhone on the strength of this app alone. Open the drive on a computer, look at the photos, and satisfy yourself that they are there before you remove anything.

5. Free tier and My Photo Copy Pro

The first 250 photos and videos back up free, with verification switched on. My Photo Copy Pro removes that limit. Two products are offered, and both unlock exactly the same thing:

My Photo Copy Pro (Lifetime) — a one-time purchase. It does not renew.
My Photo Copy Pro (Yearly) — an auto-renewable subscription with a term of one year.

Both support Family Sharing.

Subscription terms

Payment is charged to your Apple Account at confirmation of purchase.
The subscription renews automatically for a further year unless auto-renew is turned off at least 24 hours before the end of the current period.
Your Apple Account is charged for the renewal within 24 hours before the end of the current period, at the then-current price for your region.
You can manage the subscription and turn off auto-renew in your Apple Account settings at any time after purchase.
The price shown in the app before you buy is the price for your region, in your currency, including any applicable tax.
Cancelling stops future renewals; it does not shorten the period you have already paid for.

Refunds

Apple sells the app and both products, and Apple handles all refunds. Requests go to reportaproblem.apple.com. We cannot issue a refund ourselves, but write to us anyway if something went wrong — usually there is a fix, and if there is not we would like to know.

Right of withdrawal: as an EU consumer you have a 14-day right of withdrawal for digital content. By starting to use a purchased unlock immediately you agree to immediate performance and acknowledge that the right of withdrawal lapses on delivery, as Apple's terms of sale set out.

6. Your responsibilities

Copy only material you have the right to copy.
Keep your drive somewhere you are content for your photographs to be. The files on it are unencrypted and readable by anyone holding the drive.
Check the drive yourself from time to time. The app's "Check this drive" feature reads every file back and compares it with the record; a drive that has begun to fail will show up there.

7. Warranty and liability

The app is provided as it is. Beyond the statutory warranty rights you have as a consumer under Austrian and EU law, which these terms do not limit, we give no guarantee that the app will be uninterrupted, error-free, or compatible with every drive, adapter or configuration.

Our liability is unlimited for damage caused intentionally or by gross negligence, for injury to life, body or health, and wherever mandatory law imposes liability regardless of fault — including the Austrian Product Liability Act. For slight negligence we are liable only for breach of an obligation essential to the purpose of this agreement, and then only for foreseeable damage typical of this kind of agreement. Any further liability is excluded.

Nothing in these terms limits your rights under mandatory consumer protection law in the country where you live.

8. Data protection

How the app handles your photographs and the very small amount of personal data involved is set out in the Privacy Policy, which forms part of these terms.

9. Changes

We may change the app, and we may change these terms when the app or the law changes. The effective date at the top of this page always says when the current version took effect. Changes that materially reduce what you get will not be applied retroactively to a purchase you have already made.

10. Governing law and disputes

Austrian law applies, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory law of the country where you habitually reside, and you may bring proceedings in the courts of that country.

The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obliged, and are not willing, to take part in dispute resolution proceedings before a consumer arbitration board — please just write to us first; it is faster.
